TERMS AND CONDITIONS

1. Introduction

1.1 These terms and conditions (the “Terms”) govern the sale of wooden watches and accessories (the “Products”) by Wegarti, a VOF registered in the Netherlands under registration number 89694058, with its registered office located at Loenermark 228, 1025SW Amsterdam (the “Company”).

1.2 The Company operates the website www.wegarti.com (the “Website”) through which it offers for sale the Products to the customers (the “Customers”).

1.3 By placing an order for the Products on the Website, the Customers agree to be bound by these Terms.

2. Orders and Delivery

2.1 The Products and the prices for the Products are set out on the Website.

2.2 The Customers can place an order for the Products on the Website by following the instructions provided on the Website.

2.3 The Company will confirm the receipt of the order by sending an email to the email address provided by the Customer during the ordering process. The order confirmation email will set out the details of the order, including a description of the Products ordered and the total price.

2.4 The Company will deliver the Products to the delivery address provided by the Customer during the ordering process. The delivery times are estimates only and the Company will not be liable for any delay in delivery.

2.5 The risk of loss or damage to the Products will pass to the Customer upon delivery of the Products to the delivery address provided by the Customer.

3. Payment

3.1 The Customers must pay the total price for the Products and the delivery charges at the time of placing the order.

3.2 The Company accepts payment by credit card and PayPal.

3.3 The Company will not process the order until the payment has been received in full.

4. Warranty

4.1 The Company warrants that the Products will be free from defects in material and workmanship for a period of 1 year from the date of delivery.

4.2 If a Product is found to be defective within the warranty period, the Customer should contact the Company at [email protected]. The Company will either repair or replace the defective Product, or refund the purchase price, at its sole discretion.

4.3 The warranty does not cover normal wear and tear or any damage caused by accidental damage, misuse, abuse, or modification of the Products.

5. Returns

5.1 The Customers have the right to return the Products within 30 days of delivery for a full refund.

5.2 The Products must be returned in their original packaging, unused, and in the same condition as when they were received by the Customer.

5.3 The Customer must contact the Company at [email protected] to initiate the return process. The Company will provide instructions on how to return the Products.

5.4 The Customer will be responsible for the cost of returning the Products to the Company.

6. Limitation of Liability

6.1 The Company will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the sale of the Products, including but not limited to loss of profits, loss of revenue, loss of data, or loss of business opportunity.

6.2 The total liability of the Company arising out of or in connection with the sale of the Products, whether in contract, tort (including negligence), or otherwise, shall not exceed the purchase price of the Products.

7. Governing Law and Jurisdiction

7.1 These Terms will be governed by and construed in accordance with the laws of the Netherlands.

7.2 Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of the Netherlands.

8. General

8.1 These Terms constitute the entire agreement between the Company and the Customer with respect to the sale of the Products and supersede all prior or contemporaneous communications, representations, and agreements, whether written or oral.

8.2 The failure of the Company to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

8.3 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Changes to the Terms

9.1 The Company reserves the right to modify these Terms at any time and without prior notice. The Customers should review these Terms regularly to be aware of any changes. The continued use of the Website and the purchase of the Products following any changes to the Terms will be deemed acceptance of such changes.
